U by Kotex 'U Privileges' - St Tropez EveryDay Face

  1. Information on how to claim the St Tropez EveryDay Face forms part of these Conditions of Offer. The submission of a claim in the U by Kotex ‘U Privileges' St Tropez EveryDay Face Offer (Offer) is deemed to be an acceptance of these Conditions of Offer.
  2. Offer commences at 08.00 am AEDT on 8 December 2008. Offer ends at 5.00pm AEDT on 31 December 2008 or immediately after all 30 bottles of St Tropez EveryDay Face are claimed, whichever occurs first (Offer Period). This offer is strictly limited to the first 30 valid claimants as determined by the Promoter.
  3. Entry is only open to Australian residents aged 13 years and over who are members of U by Kotex U Privileges club. To register as a member of the U Privileges club log on to www.ubykotex.com.au. Employees (and their immediate families) of the Promoter, or agencies or companies associated with this Offer, are ineligible to enter.
  4. Claimants can only enter in their own name. The Promoter reserves the right to request the claimants to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter's satisfaction, at its sole discretion) in order to confirm the claimants' identity, age, residential address, eligibility to claim, and any information submitted by the claimant in submitting a claim in the offer, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or a claim has not been verified or validated to the Promoter's satisfaction within the time requested, that claim will become invalid.
  5. All prizes will only be awarded following any claimants validation and verification that the Promoter requires in its sole discretion.
  6. To claim, eligible claimants must, during the Offer Period, log on to www.ubykotex.com.au and complete the online claim form in full and submit in the manner required. In order to fully complete the claim form, eligible claimants will be required to provide their full name, date of birth, residential address, current and valid email address, mobile telephone number, gender, and any other compulsory information as outlined in the online claim form. To verify their claim, eligible claimants may be required to click on a link contained in a verification email that will be sent to the claimants nominated email address after the claim has been received.
  7. A maximum of one claim per person and per household may be made.
  8. All successful claimants will be notified via email once claims have been verified.
  9. The first valid 30 claims received by the Promoter will receive a St Tropez EveryDay Face 50ml valued at $29.95. Total prize pool value is up to $898.50.
  10. The value of the St Tropez EveryDay Face is accurate at the date of commencement of the Offer. The Promoter accepts no responsibility for any variation in the value of the St Tropez EveryDay Face after that date. The St Tropez EveryDay Face cannot be transferred, exchanged or redeemed for cash. The Promoter retains the right to substitute the St Tropez EveryDay Face with a product of equal or greater value .
  11. Claimants should allow 45 days for delivery of the St Tropez EveryDay Face.
  12. The Promoter's decision is final, and no correspondence will be entered into, including in the event of a dispute.
  13. The Promoter and its associated agencies or companies accept no responsibility for lost, late, stolen, damaged or misdirected claims.
  14. The Promoter may dispose of any St Tropez EveryDay Face remaining at the close of the Offer in any manner it determines.
  15. If for any reason this Offer is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the Offer including the St Tropez EveryDay Face and these Conditions of Offer.
  16. The Promoter reserves the right to verify the validity of claims and reserves the right to disqualify any entrant for tampering with the claim process or for submitting a claim which is not in accordance with these Conditions of Offer, or if the claimant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Offer. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  17. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to claimants or any other person's mobile handset or computer related to, or resulting from, participation in this offer or the downloading of any materials related to this offer.
  18. Any costs associated with accessing the Promoter's website remain the responsibility of each claimant and are dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid and will result in an ineligible claim.
  19. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Offer, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) claims that are late, lost, damaged or misdirected prior to their receipt by the Promoter, or after receipt due to reasons beyond the reasonable control of the Promoter; (d) any variation in offer value to that stated in these Conditions of Entry; and (d) any tax liability incurred by a claimant; or (e) receiving, taking or using of a prize.
  20. The Promoter will not be liable for any breach by an claimant of an acceptable use policy or other policies to which the claimant may be subject, in regards to this Offer including but not limited to submitting electronic claims to the Offer. Claimants acknowledge that they must ensure that any emails they send as part of this Offer should not contain inappropriate, indecent or offensive content or content in breach of any laws.
  21. All claims and any copyright subsisting in the claims become and remain the property of the Promoter. The Promoter collects personal information about claimants to include claimants in the offer and where appropriate award prizes. If the personal information requested is not provided, the claimant may not participate in the offer. By participating in the offer, each claimant also acknowledges that a further primary purpose for collection of claimants personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact claimants in the future with information on special offers or provide claimants with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners who may contact claimants with special offers in this way. By submitting a claim in this offer, each claimant agrees that the Promoter may use claimants' personal information in this manner. Claimants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter. A copy of the Promoter's Privacy Policy in relation to the treatment of personal information collected may be obtained by visiting www.kca.com.au or by contacting the Promoter.
