CONDITIONS OF ENTRY

U BY KOTEX LINERS WIN A PHILIPS BIKINI PERFECT PROMOTION

  1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant. Entry is via Internet only.
  2. Any costs associated with accessing the promotional website remain the responsibility of each entrant and are dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid and will result in an ineligible entry.
  3. Entry into the promotion is only open to Australian residents who purchase a specially marked U by Kotex Liners product from any participating retail store in Australia during the Promotional Period (an "Eligible Purchase"). Employees (and their immediate families) of the Promoter and printers, suppliers, providers and agencies associated with this promotion are ineligible to enter.
  4. To enter, eligible entrants must make an Eligible Purchase and must then, during the Promotional Period, log on to www.ubykotex.com.au and complete in full and submit in the manner required the online entry form. In order to fully complete the entry form, eligible entrants will be required to provide their full name, date of birth, residential address, current and valid email address, mobile telephone number, gender, the unique code found on the sticker of the specially marked U by Kotex Liners product purchased and the barcode from the specially marked U by Kotex Liners product purchased. To verify their entry, eligible entrants must then click on the link contained in the verification email that will be sent to the entrant’s nominated email address after the entry has been received.
  5. The promotion commences at 8:00am (AEDT) on 13/10/2008 and closes at 5:00pm (AEDT) on 21/12/2008. Winners will be notified instantly on screen and by mail or email. All reasonable steps to notify winners will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
  6. Once an entrant submits their entry and the Promoter receives the online entry form and confirms the entry has been successfully received, a message will appear on screen immediately and advise whether or not they are an instant winner. If an online entry is not successful because the barcode or unique code submitted by an eligible entrant is not recognised by the Promoter as an eligible barcode or unique code for the promotion, a "try again" message will appear on screen. The "try again" message will prompt the entrant to check their barcode or unique code and resubmit their online entry in the required manner.
  7. Multiple entries will be accepted but on each occasion an eligible entrant’s entry must fully comply with the entry requirements applicable to this promotion, must be based on a separate Eligible Purchase, a separate unique code and must contain the barcode from a different specially marked U by Kotex Liners product. The Promoter accepts no responsibility for late, lost or misdirected entries. Incomplete, ineligible or incomprehensible entries will be deemed invalid. Entries must be received by the Promoter during the Promotional Period. Internet entries will be deemed to be accepted at the time of receipt and not at the time of transmission.
  8. Instant win prizes: There will be 560 instant win prizes awarded during the Promotional Period. The instant win prize pool consists of 560 x Philips Bikini Perfect (product code: HP6371), each prize valued at up to $79.95 (Recommended Retail Price including GST). Instant win prizes will be mailed to each winner’s nominated address within 28 days of the date they are advised that they have won the instant win prize.
  9. A total of 560 instant winners will be selected during the Promotional Period.  8 times will be randomly selected each day during the Promotional Period ("Instant Win Time Slot") and one instant win prize will be allocated to each Instant Win Time Slot.  If an entry is received at the Instant Win Time Slot the entrant will win an instant win prize subject to satisfying the winner validation and verification requirements.  If no entry is received at any Instant Win Time Slot then the relevant instant win prize will be awarded to the next eligible entry received.
  10. Total maximum prize value is up to $44,772.00 (Recommended Retail Price including GST). Prizes are not transferable or exchangeable and cannot be taken as cash. Prizes must be taken as offered and cannot be varied. All warranty claims in respect of the prizes must be directed towards the applicable manufacturer and not the Promoter. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for prizes lost or damaged in transit.
  11. If any prize or any element of a prize becomes unavailable for any reason beyond the Promoter’s reasonable control, then a similar prize or prize element of equal or greater value will be awarded to the winner in lieu, subject to any written directions made under applicable State and Territory legislation.
  12. Each eligible entrant must retain and may be required to present proof of purchase in order to claim a prize. Entrants may be requested to provide to the Promoter proof of purchase for all entries made. If an entrant is unable to provide proof of purchase for all entries made, then all the entries of that entrant will be ineligible and deemed invalid. Proof of purchase includes showing an original and providing a photocopy of the store receipt for each Eligible Purchase and the product packaging containing the unique code and barcode for each Eligible Purchase.
  13. Entrants can only enter in their own name. The Promoter reserves the right to request the winners to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the winners’ identity, age, residential address, eligibility to enter and claim a prize, and any information submitted by the winners in entering the promotion, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or a winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, that winner’s entry will become invalid.
  14. All prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion. The Promoter may conduct such further draws as are necessary at 12:00pm (AEDT) on 16/3/2009 at 52 Alfred Street Milsons Point NSW 2061 in order to distribute any prizes unclaimed by that date subject to any written directions given under Reg 37 of the Lottery and Gaming Regulations 1993 (SA) or other State or Territory legislation. All winners in any unclaimed prize draw will be notified by mail or email.
  15. The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking the prize or using the prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  16. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  17. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
  18. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions made under applicable State or Territory legislation.
  19. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
  20. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  21. Caution: any attempt to cause malicious damage or interference with the normal functioning of the promotional website or the information on the website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an entrant, the entrant agrees to indemnify the promoter for those losses, damages and costs.
  22. Printing and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these terms and conditions all prize claims in excess of the advertised prize pool will be met. Promotional materials void if stolen, forged, mutilated or tampered with in any way or if the product barcode or unique code fails the Promoter's validation tests. Such Promotional materials are void and ineligible to enter the promotion.
  23. Prizes will only be awarded where the barcode and unique code fulfils all of the requirements of the Promoter's verification tests and procedures. The verification tests and procedures shall be determined by the Promoter in its absolute discretion.
  24. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. The winners agree to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
  25. All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners who may contact entrants with special offers in this way. By entering the promotion, each entrant agrees that the Promoter may use entrants’ personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media as required under the relevant lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
